Terms of Service

These Terms of Service ("Terms") set out the conditions on which Sholokhov Mikhail Andreevich (Sole Trader) ("Provider", "we", "us") offers, and you ("Customer", "you") may use, the Lernica website at lernica.app, the Lernica mobile apps, and related services (together, the "Service"). By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.

1. The Service

Lernica is a language-learning service with an AI tutor. It includes conversations with an AI tutor by voice and text, feedback on each phrase you say ("Better to say" and an explanation), hints, word practice, reading and listening exercises, level tests, and progress features such as streaks and leagues. 20 study languages are available. Features may differ between the website and the apps.

The free plan has daily limits (for example, a limited number of minutes of conversation per day). Lernica Premium removes or raises these limits as described on the Pricing page at the time of purchase.

2. Accounts

• You must provide a valid email address and keep your sign-in details secure.
• You must be old enough to enter into a contract in your country, or use the Service with consent of a parent or guardian.
• One Premium subscription applies to one Lernica account. Premium bought on the website also works in the Lernica apps when you sign in with the same account.

3. Subscriptions, free trial, and renewal

• Lernica Premium is sold as an auto-renewing subscription with a weekly, monthly, or yearly billing period. The price, currency, and billing period are shown before you pay.
• Some yearly plans include a free trial (for example, 3 days). A payment method is required to start the trial. If you do not cancel before the trial ends, the yearly subscription starts and you are charged the yearly price. One free trial per account.
• The subscription renews automatically at the end of each billing period and the payment method on file is charged, until you cancel.
• You can cancel at any time in your profile on lernica.app or by writing to support@lernica.app. After cancellation you keep Premium until the end of the period already paid for; no further charges are made.
• Subscriptions purchased inside the iOS app through Apple are billed and managed by Apple under Apple's terms and are cancelled in your Apple ID settings.

4. Payment

Payments with international cards and wallets are processed by Paddle.com, which acts as our online reseller and merchant of record for these orders. Paddle handles billing, taxes, and payment-related customer service for those transactions; Paddle's buyer terms also apply. Applicable taxes may be added at checkout depending on your location. We do not store full card numbers.

The first payment of a subscription is covered by a 14-day money-back guarantee. Refunds are described in our Refund Policy.

5. AI-generated content

The tutor's replies, corrections, and explanations are generated by AI models. They are usually helpful but may sometimes be inaccurate or incomplete. Lernica is a learning tool and does not provide professional, legal, medical, or exam-certification advice. You are responsible for what you write or say to the tutor.

6. Acceptable use

You agree not to misuse the Service, including: attempting to bypass limits or payment; scraping or reselling the Service; using it to create unlawful, sexual, violent, hateful, or harassing content; or interfering with its security. We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

The Service, its software, content, tutors' characters, and branding belong to the Provider or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own learning while these Terms apply. You keep the rights in content you submit and allow us to process it to provide and improve the Service, as described in the Privacy Policy.

8. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. We may change features, prices, or these Terms. Price changes apply to new purchases and to renewals after notice; the "Last updated" date on this page will change when the Terms are updated.

9. Liability

To the extent permitted by law, the Provider is not liable for indirect or consequential losses, and its total liability for any claims in any twelve-month period is limited to the amount you paid for the Service in the three months before the claim. Nothing in these Terms limits rights that cannot be limited by law, including consumer rights in your country of residence.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or end access if you materially breach these Terms or if required by law.

11. Governing law

These Terms are governed by the laws of the Republic of Armenia, except where mandatory consumer protection rules of your country of residence apply. We will try to resolve any dispute through negotiation first; courts in Yerevan, Armenia, have jurisdiction unless mandatory law gives jurisdiction to the courts of your place of residence.
